CONSULTANCY SERVICES FOR

ELABORATION OF THE FRAMEWORK LAW ON URBANIZATION

 

 

1. The Government of Mozambique, represented by the Ministry of State Administration and Public Servant (MAEFP) has received financing from the World Bank, toward the cost of the Mozambique Urban Development and Decentralization Project which benefits 22 Municipalities in the Provinces of Niassa, Zambézia, Sofala and Gaza. The Project Development Objective is to “Strengthen institutional performance and provide improved infrastructure and services to local entities.

2. The scope of this work falls within the implementation phase of Mozambique’s Urbanisation Policy, approved by the Council of Ministers by Resolution no. 31/2024 of 10 July, which will entail an institutional arrangement, modes of action and funding modalities in Mozambique’s urban sector. The urbanisation policy highlights 7 pillars, on different thematic areas: 1. Governance and Decentralisation, 2. Land Management and Spatial Planning, 3. Economic and Financial Development, 4. Access to Housing and Adequate Settlements, 5. Inclusive Access to Resilient Infrastructure and Basic Services, 6. Mobility and Accessibility and 7. Urban Resilience and Environment.

3. The detailed Terms of Reference (TOR) for the assignment can be found in the annexes below, or should be requested by E-mail at the address given below.

4. The MAEFP – PDUL/PMU now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are: (i) Experience in drafting legislation and (ii) Previous experience in drafting framework law or similar assignments. Key Experts will not be evaluated at the shortlisting stage.

5. The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” effective on September 2023, setting forth the World Bank’s policy on conflict of interest.

6. Attention is drawn to the Procurement Regulations requiring the Borrower to disclose information on the successful bidder’s beneficial ownership, as part of the Contract Award Notice, using the Beneficial Ownership Disclosure Form as included in the bidding document.

7. Consultants may associate with other firms to enhance their qualifications, in the form of a consortium or a sub consultancy but should indicate clearly whether the association is in the form of a joint venture and or sub consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

8. A Consultant will be selected in accordance with the Quality and Cost Based Selection (QCBS) method set out in the World Bank Procurement Regulations.
